REFUND_PROTOCOL

1. ELIGIBILITY

Refunds are evaluated based on project milestones and deliverables:

  • Full Refund: Available within 14 days of contract signing if no work has commenced.
  • Partial Refund: Proportional to work completed if project is terminated mid-development.
  • Milestone-based: Payment is released upon approval of each project milestone.

2. NON_REFUNDABLE

  • Work already completed and approved by client.
  • Third-party costs incurred (domain registration, hosting fees, API subscriptions).
  • Custom design work after initial concept approval.

3. REQUEST_PROCESS

Refund requests must be submitted in writing to [email protected] within 30 days of the relevant invoice date. We will respond within 5 business days with a resolution.

4. DISPUTE_RESOLUTION

Disputes will be resolved through negotiation. If unresolved, parties agree to submit to the jurisdiction of Barcelona courts.

1. SERVICE_SCOPE

nextphrasepro provides web development services including API integrations, front-end development, backend architecture, and related digital solutions. Service details are defined in individual project proposals.

2. CLIENT_OBLIGATIONS

  • Provide timely access to required resources and information.
  • Designate a point of contact for project communications.
  • Review and approve deliverables within agreed timeframes.
  • Make payments according to the agreed schedule.

3. INTELLECTUAL_PROPERTY

Upon full payment, all intellectual property rights for custom-developed code and designs transfer to the client. nextphrasepro retains the right to use anonymized project data for portfolio and marketing purposes unless explicitly prohibited in writing.

4. CONFIDENTIALITY

Both parties agree to maintain confidentiality of proprietary information shared during the project engagement. This obligation survives termination of the agreement for a period of 24 months.

5. LIMITATION LIABILITY

nextphrasepro's liability is limited to the total amount paid for the specific service giving rise to the claim. We are not liable for indirect, consequential, or incidental damages.

6. FORCE_MAJEURE

Neither party shall be liable for delays or failure to perform due to circumstances beyond reasonable control, including but not limited to natural disasters, war, pandemic, or infrastructure failures.

7. GOVERNING_LAW

These terms are governed by Spanish law. Any disputes shall be resolved in the courts of Barcelona, Spain.

8. MODIFICATIONS

nextphrasepro reserves the right to modify these terms. Clients will be notified of significant changes via email. Continued use of services constitutes acceptance of modified terms.
